What Cannot Be Registered as Industrial Designs

Non-Registrable Designs Under Registered Designs Ordinance 2000

The following are excluded from industrial design registration in Pakistan:

  • Non-Original Designs: Designs lacking novelty or originality as determined by the Registrar
  • Previously Published Designs: Designs identical or substantially similar to designs already registered or published worldwide before application date
  • Construction Methods: Methods or principles of construction, or improvements in construction arrangement
  • Functional Features: Features dictated solely by function that the article must perform
  • Trademarks: Marks defined under the Trade Marks Act, 1940
  • Simple Combinations: Mere adjunctions of two or more known articles of known shape or patterns
  • Copyright Works: Works protected under Copyright Ordinance, 1962 including sculptures, wall plaques, medals, and printed materials
  • Official Emblems: Designs containing reproductions of official emblems, seals, coats-of-arms, or flags without authorization
  • Names/Portraits: Designs containing names or portraits of living or dead persons without consent
  • Prohibited Emblems: Names or emblems protected under Pakistan Names and Emblems Act, 1957

Exception: Under Section 6, registered proprietors may apply for registration of the same design for other articles, or with modifications not altering the character, without refusal based on previous registration.
